By accessing the website at http://www.nillion.com (“Website”), you as the visitor (“you” or “your”) are agreeing to be bound by these terms of use (“Terms”) of the Nillion Association with legal seat in Zug, Switzerland (“Association”, “we” or “us”), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from visiting or using this Website. The materials contained in this Website are protected by applicable copyright and trademark law.

We reserve the right to change these Terms at any time in our sole discretion. You can access the latest version of these Terms at any time at https://nillion.com/terms-of-service/. The Terms in force at the time of your use of the Website apply. Updated Terms are binding on you with respect to your use of the Website on or after the date specified in the updated Terms. If you do not agree to the updated Terms, you must stop using the Website. Your continued use of the Website after the date of the updated Terms will constitute your acceptance of the updated Terms.

Eligibility

We do not guarantee that our Website or any content on it will continuously be available or accessible without interruption. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to all or part of the Website.

No Interaction with Nillion Network

This Website only provides educational materials and information about the Nillion Network (“Network”). By visiting and/or using the Website, you are not interacting with the Network in any way. We do not and cannot control the activity and data on the Network or the activities that users, nodes, validators, developers and other third parties may conduct on the Network.

No Involvement of the Association in Nillion Network Products and Services 

While the Association’s purpose is to support the development of the Network, the Association does not operate the Network and does not provide you with any products and/or services related to the Network.

You agree and acknowledge that the Network, as open-source software, is being used or implemented by any party in accordance with the applicable license. At no time shall the Network, its implementations, and/or related components be a product or service provided or made available by the Association in any capacity. Therefore, by using, interacting with, or implementing the Network or any of its related components, you are NOT interacting with the Association in any way.

The Association makes no representations, warranties or covenants with respect to the Network (or any implementations and/or components thereof), including, but not limited to, with regard to their technical properties and/or characteristics or performance, or their actual or potential usefulness or suitability for any particular purpose.

Third Party Links 

The Website may contain links to websites and content that is controlled or operated by third parties (“Third Party Links”). The Association is providing these Third Party Links to you only for convenience and the inclusion of any Third Party Links on the Website does not imply any endorsement by the Association of the Third Party Links and/or their operators. The Association is not responsible for any content contained in or associated with the Third Party Links.

Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by the Association, its licensors, or other providers of such material and are protected by Swiss and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent. The Association name, the Association logo, and all associated names, logos, product and service names, designs, and slogans are trademarks of the Association or its affiliates or licensors. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners. Under no circumstances does your use of the Website grant you any ownership rights or other interest in any such marks or content on the Website.

Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the substantive laws of Switzerland. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. Any dispute arising out of or in conjunction with these Terms shall be submitted to the exclusive jurisdiction of the ordinary courts of the city of Zug, Switzerland.
